Workers' Compensation
Workers' compensation cases are in regard to any type of physical injury that happens at work. All employers in Michigan are required by law to have worker's compensation insurance. It does not matter who is at fault or even if the worker is at fault. However, there is no award for pain and suffering in a worker's compensation case. Damages are based on 80% of the worker’s average net weekly earnings up to the capped amount based on the average weekly wage in the State of Michigan. Damages also include unpaid medical bills and prospective ones to be incurred in the future.
