Worker's Compensation

Your family counted on your wages when you were working - a LOT is at
stake. The insurance companies vigorously fight against paying full and
proper benefits to injured workers, especially in serious Workers'
Compensation cases.  Our dedicated attorneys, case managers and
investigators will gather all the employment and medical records,

The first thing you need to understand is that Michigan Workers'
Compensation is a form of Insurance purchased by employers to protect
their employees. Most people employed in the state of Michigan are
covered by Worker's Compensation Insurance that protects them
financially should they ever become injured while at work or in the
course of employment.  

Michigan law provides that a worker who suffers an injury on the job is
entitled to file a Workers' Compensation claim and seek wage loss,
medical benefits and vocational rehabilitation, if necessary. As with
any injury situation, it is wise to consult with an attorney if there
is a question regarding coverage, as these laws can be complex.

There are some categories of employees who may not be covered by
Michigan Workers' Compensation.  This includes Federal Employees (such
as postal workers, military personnel, railroad workers, seamen and
Veteran's Hospital employees) and Agricultural Workers.  In such
instances, there are other Federal statutes which supersede Michigan's
Worker's Compensation laws to provide injury disability benefits.  You
should check with your employer to see if Michigan Worker's
Compensation coverage has been obtained.

Certain small businesses with 3 or fewer employees may also be exempt
from carrying Workers' Compensation insurance.  It is best to check
with your employer and consult with an attorney if there are any
questions concerning coverage.

Wage Loss Benefits

In Michigan, the current formula for determining wage loss benefits in a
Workers' Compensation claim is to pay 80% percent of a worker's after
tax salary.  In a simplified example, if you're weekly salary after
taxes is one hundred ($100.00) dollars, then your Worker's Compensation
benefit should be eighty ($80.00) dollars.

One area that often causes concern is when a worker's weekly salary
varies from week to week.  In such an instance, Michigan law provides
that Workers' Compensation benefits are determined by looking at the 39
highest pay weeks in the past 52 week period and calculating an average
pay amount.  These formulas can be confusing and legal counsel should
be consulted if there are any questions.

Medical Benefits

All reasonable and necessary medical benefits are to be provided under
Michigan's Workers' Compensation law.  However, disputes may arise
regarding what is reasonable and necessary.  As long as the treatment
is for the work related injury, benefits should stay in place
indefinitely.  In the event of a dispute, it is often necessary to seek
legal guidance. If you are denied benefits, and you are unable to work,
you should immediately contact our office.

Question: Can I choose my own Doctor to treat my work related injury?

Answer: For the first 10 days of treatment, you are required under the
Workers' Compensation Laws to see the Doctor of your employer's
choosing.  After these 10 days, the law allows you to choose your own
treating physicians as long as your employer is properly notified of
your intentions.
